Financial Education Counseling Disclosure Statement

I understand that the purpose of the financial education counseling program offered by Credit Advisors Foundation is to counsel me regarding options available to me in resolving my financial situation including information on budgeting, negotiating with creditors, debt management plans and bankruptcy. I understand this counseling is provided by a Credit Counselor certified by Arbor Investment in Financial Education or by the National Foundation for Credit Counseling.

I understand that Credit Advisors Foundation does not have the authority to approve or deny any bankruptcy petition for the court and is not an agent for any attorney or trustee of the bankruptcy courts.

I understand that completion of the Credit Advisors Foundation financial counseling program and receipt of a certificate to that effect does not guarantee that any bankruptcy petition submitted by me to the court will be approved by the court and safe from objections by creditors. I understand that the counseling will not be complete until I have engaged in a follow up session with a counselor by telephone following the completion of the counseling session. The client will receive a certificate only if the client completes counseling services.  At the conclusion of your follow up session we will promptly provide your certificate of completion. I understand that Credit Advisors will only deliver my certificate to my attorney based on information provided by me when I created my account and that it is my responsibility to follow up and ensure my certificate gets filed with the bankruptcy court. I understand this certificate expires 180 days after my counseling is completed.

I understand that by signing this form I attest that all information provided by me is true and correct. I will read the financial tutorial in its entirety and complete the pre- and post- tests on my own. This is a complicated area of law and an attorney should be consulted on all matters relating to bankruptcy. The information is provided with the understanding that the authors and publishers are not herein engaged in rendering bankruptcy, legal, insolvency, tax, or other professional advice and services. As such, it should not be used as a substitute for consultation with professional bankruptcy, insolvency, tax, legal or other competent advisors. While we have made every attempt to ensure that the information provided has been obtained from reliable sources, Credit Advisors Foundation is not responsible for any errors or omissions, or for the results obtained from the use of this information. Bankruptcy and any financial counseling program may have a derogatory impact on my credit report.

I understand the cost of this counseling is $25.00. I can pay this fee with a debit card, credit card, PayPal, electronic checks, or money order. Credit Advisors does not offer discounts to our online program other than a complete fee waiver based on ability to pay. If you have a prepaid code from your attorney the amount paid for this code is $25.00. If your attorney charged you an amount above this fee you must consult the attorney with billing questions or a refund for the difference.

Credit Advisors will provide services without regard to a client’s ability to pay and will not withhold a certificate of counseling because of an inability to pay. We do have a fee waiver program. Eligibility will be determined during the online registration process. If you are eligible for a fee waiver of the $25.00 fee for this counseling you may apply for final approval by completing the Fee Waiver Request Form. We will review the information and let you know if you are eligible for a fee waiver based on the information you provide and if your income is less than 150 percent of the poverty guidelines published by the United States Department of Health and Human Services. Credit Advisors will provide free bilingual counseling services or professional interpreter assistance to any limited English proficient client. I understand that the financial education counseling program that I am enrolling in today is not a debt management plan, however, Credit Advisors Foundation may receive funding from clients enrolled in a debt management plan. They may also receive funding from creditors based upon payments made by clients enrolled in a debt management plan. You have the opportunity to negotiate an alternative payment schedule per 11 USC 502(k).  There may be additional fees associated with their service. Credit Advisors Foundation neither receives nor pays a fee for the referral of clients.

I understand that my information may be disclosed to the United States Trustee in connection with their oversight of Credit Advisors Foundation, or during the investigation of complaints, during on-site visits, or during quality of service reviews. The United States Trustee has reviewed only the agency’s credit counseling services but has not reviewed nor approved any other services Credit Advisors Foundation provides to clients.

I grant Credit Advisors the right to obtain a copy of my credit report.
